GOJINET INC. and its Affiliates (GOJI or we, our or us) values our customers, including you (you or your) and we respect your privacy and personal information which is information about an identifiable individual (as defined by applicable privacy or data protection laws). This privacy policy (this Policy) applies to users of our website http://gojinet.com (the Website), mobile application (the App), products and services (the Services) and describes the kinds of personal information we collect about you through our Website and our App, why we collect it, how we use it, how we protect it, and under what circumstances we share it with third parties. This Policy also describes the decisions you can make about your personal information. You may require us to change, amend or delete the personal information that you have provided to us at any time. Affiliates means any entity directly or indirectly controlling or controlled by, or under control with, GOJI. Students are the users who arrange a live video or audio chat session (the Session) with a native English speaker (the Tutor) through our Website or App.

If this Policy changes in the future, we will post an updated version on our Website. We recommend that you check our Website periodically in order to review our current Policy. You can tell if this Policy has changed by checking the effective date that appears at the bottom of this Policy. Depending on the circumstances, we may also decide to send you notice that the Policy has changed using other methods at our discretion, including via email. If you continue to use the Services after the Policy has changed or notice has been given to you of a change in the Policy, you will be deemed to have accepted such changes. 

 

1. Information We Collect

When you use our Services, we collect your personal information to enable us to provide you Services and to customize our service to meet your special needs. Information may be collected directly from you or from third parties with your consent or as permitted or required by law. More specifically, we collect the following types of information:

(a) Account and Membership Information: In order to use some features of the Website or App, you must first register to create an account and subscribe to the applicable GOJI Service. During registration, we collect your name, email address, username, password, profile picture, date of birth, gender, nationality and other information you choose to provide. Additionally, Students must provide at least one valid payment method (either a credit card or an Alipay account), and Tutors must provide their Stripe account information, social insurance number, and chequing account information for direct deposits. We will also collect any updates or changes you make to your account information.

(b)  Information regarding applications used on your Computer or Device: When you access our Services using a computer or other device (such as a smartphone or tablet), we collect information about that computer or device. This information may include the language and time-zone used by the computer or device, the browser you used to access the Website, your IP address and domain name, the features of the Website or App that you use, the date and time of your visit, the files that you download, the URLs of websites you visit before and after accessing the Website, your software and hardware attributes (including device IDs). To collect this information, we may use web logs or applications that recognize your computer or device and gather information about its online activity.

(c)  Third Party Information: We may engage third parties to collect, analyze, and use information. For example, we may allow third parties to set cookies or use web beacons on the Website or in email communications from GOJI. We treat all such information in accordance with this Policy. The terms and conditions between us and such third parties, if any, may also apply. However, the third party’s own use of your information in such cases will be determined by your agreement(s) with the third party, unless that third party is one of our service providers.

(d)  Third Party Accounts: if you choose to link, create, or log in your GOJI account through a third party account (e.g., Facebook account), we may receive certain information about you from such third party service. This information may include any information that you have permitted the third party to share with us, and any information you have made public through that third party service.

(e)  Cookies: When you visit our Website, we may collect certain information about your activity on our Website, as described below under the heading “Our Use of Cookies, Log Files, Web Beacons, and Embedded Scripts”.

(f)  Location Data: If you access the Website or App on a computer or device with location tracking services enabled or by way of hardware or software involving embedded location data, we may collect information regarding the city, state, province or metropolitan region from which you access the Website or the App in addition to the IP address associated with your visit. 

(g)  Quality assurance and customer service: Your customer service emails with us and our service providers, if any, may be recorded, logged, and/or monitored for quality assurance and customer service purposes such as to assist in addressing your inquiries, troubleshooting, training and analytics to identify trends and make improvements to our Services and customer service. As part of the recording and logging of the emails, we will collect information like the identity of the sender of email, the date and time of the email, and the subject and resolution of the issue.

(h)  Financial and Sales Information: While payments made through our Services are processed through a third party, we may collect information to administer, manage, and fulfill the purchases you make. For example, we may collect your name, email address, account information, the date and time of the Session completed, the minute fee of the tutor engaged, whether payment was made, method of payment, purchase history, and if you re-used our Service. We call this information “Financial and Sales Information”.

Some of the information set out above would not by itself identify you to us or be personally identifiable and is therefore considered non-personal information. If we combine any such non- personal information with other personal information available to us, the combined information will be treated as personal information in accordance with this Policy. 

 

2. Using Information We Collect

We use the personal information we collect about you:

(a) to understand and meet your behavior, interests, needs, and preferences, and/or to provide you with the Services, content on the Services, or suggestions for content and posts on the Services, for example:

(i) for purposes related to the billing, activation, provision, maintenance, support, trouble shooting, resolving of disputes, deactivation, repair, refurbishment, replacement, upgrade or update of the Services; 

(ii)  to provide and deliver the products and services you choose, process and fulfill your transactions, facilitate payments and send you confirmations related to the transactions;

(iii)  to customize your GOJI experience by analyzing your needs, characteristics and preferences and making recommendations of matching Students or Tutors to be paired with;

(iv)  to ensure products are technically functioning as intended and to help identify and troubleshoot issues;

(v)  to fulfill or enforce any agreements or notices we provide and are associated with a particular service; and

(vi)  to manage or respond to your inquiries; 

(b)  to develop new and enhance existing Services including to communicate with you about them using various means, for example to make available or send to you:

(i)  upgrades or updates, or notices of upgrades or updates of the Services; and

(ii)  notice of promotions and upcoming events; 

(c)  to manage and develop our business and operations, for example;

(i)  to detect, monitor, investigate, mitigate or attempt to prevent fraud and technical or security issues or to protect our property;

(ii)  to allow for business continuity and disaster recovery operations;

(iii)  to enforce our legal rights; or

(iv)  for statistical purposes;

(d)  to meet legal and regulatory requirements and to respond to emergency situations, for example;

(i)  to respond to court orders, warrants or other lawful requests or legal processes;

(ii)  to provide emergency assistance in situations that may threaten the life or physical safety of you or others; or

(iii)  for any other purposes for which you have consented, such as those that may be set out in Notices, and other purposes as permitted or required by any applicable law. 

Notwithstanding anything to the contrary contained in this Policy, we may remove personal identifiers from your information and maintain and use it in a de-identified form that may be combined with other information to generate aggregated information. Such de-identified and/or aggregated information will be deemed to be owned by us and we shall have unrestricted title, rights, and interest to the de-identified and/or aggregated information which may include, without limitation, the right to use, distribute, transmit, transfer, license, trade, rent, share, assign, and sell the de- identified and/or aggregated information. We will retain your personal information as long as necessary for the fulfillment of the identified purposes or as otherwise necessary to comply with applicable laws. 

 

3. Disclosing Personal Information

In accordance with this Policy, we may share your personal information: 

(a)  within GOJI and/or with our service providers such as a cloud service provider in Canada and the United States;

(b)  with another GOJI user if you engage in any communication with such user. For example, we share your user name and any other personal information you may choose to share in connection with that communication with the other user;

(c)  with our financial, insurance, legal, accounting or other advisors that provide professional services to us;

(d)  if we have your consent;

(e)  with third parties involved in providing our Services to you such as our payment processors and logistic providers;

(f)  with third parties with whom you choose to let us share information, for example Facebook;

(g)  as necessary to complete any transactions while using our Services;

(h)  in order to respond to a subpoena, order, legal process, or government request;

(i)  in order to protect, establish or exercise our legal rights or defend against legal claims;

(j)  in order to investigate, detect, suppress, prevent or take action regarding illegal or prohibited activities, suspected fraud, situations involving potential threats to the reputation or physical safety of any person;

(k)  as otherwise required by law; or

(l) if we are to be sold, merged, or amalgamated or substantially all of its assets are to be sold or disposed of, your personal information may be transferred to a potential purchaser if, and to the extent necessary, it is required for the purposes of deciding whether to proceed with the proposed transaction and completing it. If such a sale, merger, acquisition, or disposal is completed, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with this Policy. You can always unsubscribe from receiving promotional e-mails from us by simply replying our email with the word “unsubscribe” and no other text.

We limit access to your personal information within GOJI to individuals on a need to know basis.

If you are a resident of a country which restricts data transfers outside of that jurisdiction or region without your consent, by accessing the Website, you consent to your personal information being transferred outside of your country for processing or storage by or on behalf of us.

We provide links on our Website to other, third-party sites we think you will enjoy. These sites operate independently of us and may have established their own privacy and security policies. 8. Children’s Online Privacy Protection

If you are under the age of 18, you may only use GOJI and provide information to us with your parent’s or guardian’s express consent. Please review this Privacy Policy carefully with your parent or guardian to make sure that you both understand it. 

The Services are not intended for use by children under the age of 13. GOJI does not knowingly collect or use any personal information from any children under the age of 13. If we become aware that we have unknowingly collected personal information from a child under the age of 13, we will make commercially reasonably efforts to delete such personal information from our database.
